Don Isaac Abravanel was one of the first Jewish thinkers to express republican positions, yet very little is known about his knowledge of humanistic republican conceptions. Had he read Leonardo Bruni’s republican writings? Had he even heard of them? In this essay I attempt to address this philological gap by comparing Abravanel’s republican commentary on 1 Samuel 8 with Bruni’s Laudatio florentinae Urbis, especially the motif of the plea to God to authorize a political regime. This comparison is particularly useful (...) for illuminating their respective positions on republicanism, their shared interests and conceptions, as well as their divergent attitudes to their own political and historical environment. One century after Gustav Landauer’s death, in a time marked by a deep doubt concerning modern politics, the volume proposes a fascinating overview of the articulation between _skepsis_ and _antipolitics_ in his multifaceted unconventional anarchism.

Based on evidence from press articles covering 39 corporate fraud cases that went public during the period 1992-2005, the objective of this article is to examine the role of managers' behavior in the commitment of the fraud. This study integrates the fraud triangle (FT) and the theory of planned behavior (TPB) to gain a better understanding of fraud cases. The results of the analysis suggest that personality traits appear to be a major fraud-risk factor. The analysis was further validated through (...) a quantitative analysis of keywords which confirmed that keywords associated with the attitudes/rationalizations component of the integrated theory were predominately found in fraud firms as opposed to a sample of control firms. The results of the study suggest that auditors should evaluate the ethics of management through the components of the TPB: the assessment of attitude, subjective norms, perceived behavioral control and moral obligation. Therefore, it is potentially important that the professional standards that are related to fraud detection strengthen the emphasis on managers' behavior that may be associated with unethical behavior. Prior research has documented the continued existence of an expectation gap, defined as the divergence between the public’s and the profession’s conceptions of auditor’s duties, despite the auditing profession’s attempt to adopt standards and practices to close this gap. In this paper, we consider one potential explanation for the persistence of the expectation gap: the role of media bias in shaping public opinion and views. We analyze press articles covering 40 U.S. corporate fraud cases discovered between 1992 and 2011. We (...) compare the auditor’s duties, described by the auditing standards, with the description of the fraud cases as found in the press articles. We draw upon prior research to identify three sources of the expectation gap: deficient performance, deficient standards, and unreasonable expectations. The results of our analysis provide evidence that the performance gap can be reduced by strengthening auditor’s willingness and ability to apply existing auditing standards concerning fraud detection; the standards gap can be narrowed by improving existing auditing standards; and unreasonable expectations, however, involve elements beyond the profession’s sphere of control. As a result, the expectation gap is unlikely to disappear given the media’s tendency to bias, with an overemphasis of unreasonable expectations in their coverage of frauds and press articles tending to reinforce the view that the auditor should take more responsibility for detecting fraud, irrespective of whether this is feasible at a reasonable cost. In addition to the primary role of the press in perpetuating the expectation gap, a second reason for continuation of the expectation gap is that the rational auditor will have difficulty in assessing subjective components of fraudulent behavior. Racial injustice in employment demands the attention of business organizations because it profoundly shapes our life prospects. While comparing the ideal of perfectly equal opportunity with its invariably imperfect alternatives can impede reform, the true challenge lies in addressing persistent inequities as we strive for equality. This article introduces “shared inequity” as a frame of reference for assessing workplace racial disparities and emphasizing a collective responsibility to remedy systemic issues. In critiquing an exaggerated notion of meritocracy, I emphasize that structural (...) racism, rather than just individual acts, facilitates collective advantages, especially for White males. Hence, it is morally fitting to frame racial justice in employment, not only in terms of perfect equality, but also in terms of justly sharing an imbalance that cannot be corrected without counterbalance. The “shared inequity” lens offers a more realistic and just approach to pursuing racial justice in the workplace. (shrink)

In this paper, I defend what may seem a surprising view: that John Stuart Mill’s famous harm principle would, if taken to be what justifies government action, disallow the existence of corporations. My claim is not that harmful activities of currently existing corporations warrants their losing corporate status according to the harm principle. The claim, rather, is that taken strictly, the harm principle and the legal possibility of incorporation are mutually exclusive. This view may be surprising—and I do not at (...) all mean to attribute it to Mill—but if I am right, it should be obvious. Figurative drawing is a skill that takes time to learn, and it evolves during different childhood phases that begin with scribbling and end with representational drawing. Between these phases, it is difficult to assess when and how children demonstrate intentions and representativeness in their drawings. The marks produced are increasingly goal-oriented and efficient as the child’s skills progress from scribbles to figurative drawings. Pre-figurative activities provide an opportunity to focus on drawing processes. We applied fourteen metrics to two different datasets (...) (_N_ = 65 and _N_ = 344) to better understand the intentional and representational processes behind drawing, and combined these metrics using principal component analysis (PCA) in different biologically significant dimensions. Three dimensions were identified: efficiency based on spatial metrics, diversity with color metrics, and temporal sequentiality. The metrics at play in each dimension are similar for both datasets, and PCA explains 77% of the variance in both datasets. Gender had no effect, but age influenced all three dimensions differently. These analyses for instance differentiate scribbles by children from those drawn by adults. The three dimensions highlighted by this study provide a better understanding of the emergence of intentions and representativeness in drawings. We discussed the perspectives of such findings in comparative psychology and evolutionary anthropology. (shrink)

Most syntacticians, no matter their theoretical persuasion, agree that features are the most important units of analysis. Within Chomskyan generative grammar, the importance of features has grown steadily and within minimalism, it can be said that everything depends on features. They are obstacles in any interdisciplinary investigation concerning the nature of language and it is hard to imagine a syntactic description that does not explore them. For the first time, this book turns grammar upside down and proposes a new model (...) of syntax that is better suited for interdisciplinary interactions, and shows how syntax can proceed free of lexical influence. The empirical domain examined is vast, and all the fundamental units and properties of syntax are rethought. A-t-il les moyens de clarifier la relation humaine la plus intime qui (...) soit, de résoudre toutes les tensions liées au contact avec l'altérité?? Cédric Lagandré reprend le débat du statut culturel de la sexualité en Occident pour défendre, sur le socle du consentement mutuel, sa nature nécessairement infra-juridique. On ne peut accéder innocemment à la sexualité, non au sens où le désir sexuel serait moralement coupable, mais au sens où il implique un vertige, une angoisse et une mise à nu. La forme juridique, loin de civiliser la sexualité, l'enferme donc dans un cadre défini par la prostitution, et ne la repousse pas moins que la pornographie dans le registre trivial du besoin. L'effort contemporain pour passer l'intégralité du réel au crible des catégories juridiques ne peut donc qu'échouer devant l'ordre du symbolique: l'obscurité du désir rend la sexualité insaisissable à toute volonté de l'encadrer par la règle. Formal learning theory constitutes an attempt to describe and explain the phenomenon of learning, in particular of language acquisition. The considerations in this domain are also applicable in philosophy of science, where it can be interpreted as a description of the process of scientific inquiry. The theory focuses on various properties of the process of hypothesis change over time. Treating conjectures as informational states, we link the process of conjecture-change to epistemic update. We reconstruct and analyze the temporal aspect of (...) learning in the context of dynamic and temporal logics of epistemic change. We first introduce the basic formal notions of learning theory and basic epistemic logic. We provide a translation of the components of learning scenarios into the domain of epistemic logic. Then, we propose a characterization of finite identifiability in an epistemic temporal language. In the end we discuss consequences and possible extensions of our work. (shrink)

A theory of planned behavior framework was employed to investigate the impact of corporate social responsibility perceptions on the job choice intentions of American, Chinese, and Lebanese college students. Attitudes toward CSR, subjective norm, and perceived behavioral control explained moderate levels of the variance in job choice intention in all three countries. Attitudes toward CSR, which entailed individual evaluations of CSR, were positively related to job choice intentions among Lebanese and American respondents, but not Chinese respondents. Subjective norm, the importance (...) accorded the views of significant others, was most strongly related to job choice intentions among Chinese respondents. Perceived behavioral control, the perceived degree of control over one’s actions and outcomes, had the strongest relationship to job choice intentions among American respondents. The authors concluded that respondents in the three countries did not differ in the extent to which they intend to work for socially responsible firms but tended to derive their intentions in different ways. Implications for tailoring CSR and recruitment efforts across countries are derived based on the findings. (shrink)

In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us to solve (...) all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." Self-sufficient ideographies are rare because they are stifled by the issue of standardization. Similar issues arise with abstract art or drawings created by young children or great apes. We propose that mathematical indices and artificial intelligence can help us decode ideography, and if not to understand its meaning, at least to know that meaning exists.

Most Probably: Epistemic Modality in Old Babylonian by Nathan Wasserman is the first attempt to provide a description of the domain of epistemic modality in Old Babylonian Akkadian. This attempt is not entirely successful, for several reasons. Methodological inconsistency often impairs the author’s ability to convince the reader of his solutions. Both primary data and existing secondary literature are used only selectively, which renders the proposed description problematic. This article revisits an historic exchange between two black ex-communists, Harold Cruse and Harry Haywood, a debate that prefigured many of the central contradictions of the black-power era. Their exchange followed Cruse’s influential 1962 essay forStudies on the Left, ‘Revolutionary Nationalism and the Afro-American’, which declared that the American Negro was a ‘subject of domestic colonialism’. Written against the prevailing liberal integrationist commitments of the civil-rights movement, his essay called for black economic and political independence, and inspired many of the (...) younger activists who would give birth to the black-power movement. In a series of essays for the Bay Area black radical journalSoulbook, Haywood criticised Cruse’s mishandling of class politics among blacks, and his retreat from anti-capitalism. This forgotten episode is important on its own terms, for what it says about the character and limitations of left-political thinking during the sixties, and equally for understanding and contesting those commonsensical notions of African-American public life in our times which too often remain rooted in the vanished social context and political realities of the twentieth-century racial ghetto. The role intellectual virtues play in scientific inquiry has raised significant discussions in the recent literature. A number of authors have recently explored the link between virtue epistemology and philosophy of science with the aim to show whether epistemic virtues can contribute to the resolution of the problem of theory choice. This paper analyses how intellectual virtues can be beneficial for successful resolution of theory choice. We explore the role of virtues as well as vices in scientific inquiry and their (...) beneficial effects in the context of theory choice. We argue that vices can play a role in widening the set of potential candidate theories and support our claim with historical examples and normative arguments from formal social epistemology. We argue that even though virtues appear to be neither necessary nor sufficient for scientific success, they have a positive effect because they accelerate successful convergence amongst scientists in theory choice situations. We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

How the Arab media construct Middle Eastern women as political actors, frame their leadership roles, and narrate their activities to the public are important questions largely ignored in the growing scholarship on women’s political participation in the Middle East and North Africa. Drawing on Nancy Fraser’s reflections on the politics of recognition and distribution, I examine the construction of women’s leadership in Morocco during the four-month period leading to the local elections of June 2009. Analysis of 1,738 news items from (...) five print media sources reveals that the “symbolic annihilation” of political women, a thesis traditionally applied to Western contexts, is disturbingly robust in Morocco. The Moroccan case alerts us that institutional mechanisms supporting women’s leadership might begin to address gender biases in the distribution of political power, but they do not guarantee the recognition of gender equality in the cultural sphere of knowledge production and opinion formation. Struggles over gender equity in Morocco and elsewhere in MENA should engage more fully with the politics of recognition given the disjuncture between women’s leadership competences and achievements and the dominant ideological frames constructing women’s leadership. This article focuses on the gender dimension of poverty in Morocco. It questions the inadequate parameters relied on in the existing studies on the subject and underlines their blindness to the complex causes and effects of poverty among the female population in the country. The article then approaches female poverty from its multidimensional perspective in order to underline the social, cultural, legal as well as economic aspects and implications of poverty. The United Kingdom case R v Lee EWCA Crim 1404 resulted in a pharmacist being convicted for an inadvertent dispensing error and paved way for the decriminalisation of such errors by way of a due diligence defence enacted in 2018. In relation to Hong Kong, what is its legal position for dispensing errors, and can it follow the decriminalising steps of UK? The primary objective of this paper is to explore whether and how HK can reach the normative position for (...) a dispensing error legal regime: I posit that the normative position for healthcare professional liability for dispensing errors should prioritise the public interest of minimisation of future dispensing errors over the retribution of past wrongs; I illustrate HK’s current position for the liabilities of HCPs on dispensing errors, focusing analysis on the relatively controversial aspects of HK’s criminal liability, referencing the landmark cases Hin Lin Yee v HKSAR 13 HKCFAR 142 and Kulemesin v HKSAR 16 HKCFAR 195 to assist my analysis of the requisite mental element for relevant statutory offences; through comparison with UK’s development post-R v Lee and application of Rule of Law principles, HK’s current position is critiqued, coming to the conclusion that while there are compelling reasons for the decriminalisation of dispensing errors in HK, the prerequisite for this to happen is an overhaul of regulatory frameworks by significantly increasing levels of accountability. Flagging labor governance in far-flung supply networks has prompted greater scrutiny of instrumental CSR and calls for models that are tethered more closely to accountability, constraint, and oversight. Political CSR is an apt response, but this paper seeks to buttress its deliberative moorings by arguing that the agonist notion of ‘domesticated conflict’ provides a necessary foundation for substantive deliberation. Because deliberation is more viable and effective when coupled with some means of coercion, a concept of CSR solely premised on reciprocal (...) corporate-stakeholder engagement is pre-mature; efforts should first be directed toward the antecedents of reciprocity and how it is to be achieved, and only then does deliberation become a reliably substantive exercise. The resulting account of agonistic CSR is generated through agonistic principles of realism, pro-action, contestation, and countervailence, and illustrated by the Bangladesh Accord. (shrink)
